Terms and Conditions: Clients

By registering online as a Rockmybaby® Client and agreeing to our Terms and Conditions (via the required tick box), or by engaging a Rockmybaby® Candidate for babysitting, temporary, or permanent nanny services, you acknowledge and accept these Terms & Conditions.

Links to these Terms & Conditions are available on our homepage and throughout our FAQ section for easy access.

1.0 Contract

1.1 These Terms & Conditions form a legally binding agreement between you ("Client") and Rockmybaby® Nanny & Babysitting Agency ("Agency").

1.2 Completion of any of the following constitutes acceptance of these Terms: Registering on the Rockmybaby® website, Submitting a Babysitter Booking,Submitting a Nanny Request

  • 1.3 "Candidate" refers to any individual introduced by Rockmybaby® to the Client.

  • 1.4 "Nanny" refers to a registered childcare professional engaged in a full-time, part-time, or temporary capacity.

  • 1.5 By registering with Rockmybaby® or using our website/services, you agree to abide by these Terms. If you do not agree, please do not proceed.

  • 1.6 Posting false, incomplete, or illegal information is prohibited and may result in legal action.

2.0 Client Responsibilities

  • 2.1 All communication with Rockmybaby® or its Candidates is confidential and may not be shared with third parties.

  • 2.2 All bookings must be made through Rockmybaby® directly. Booking a Candidate independently is prohibited and subject to agency fees.

  • 2.3 Clients are responsible for ensuring a safe working environment for Candidates.

  • 2.4 Rockmybaby® may decline referrals based on negative or concerning feedback about a Client.

  • 2.5 Clients must maintain confidentiality regarding Candidate details. Sharing a Candidate’s information that leads to employment by another party may result in agency fees.

  • 2.6 Clients are responsible for safeguarding their account login details and for notifying Rockmybaby® of any unauthorized use.

4.0 Nanny Candidate Obligations

  • 4.1 Clients must notify Rockmybaby® of any extension or re-engagement of a temporary placement.

  • 4.2 Any Candidate referred from another source but registered with Rockmybaby® will be subject to agency fees if employed.

  • 4.3 Placement fees apply once an offer of employment is made, unless the family is enrolled in the Rockmybaby® home-based programme, in which case a reduced placement fee will apply.

  • 4.4 Clients are the legal employer/contractor of the Candidate and must fulfill all legal obligations, including: PAYE income tax, ACC levies, KiwiSaver contributions, Visa and work eligibility checks, Providing insured, roadworthy vehicles if required to drive

5.0 Babysitter Booking Fees

  • 5.1 Fees are charged in NZD.

  • 5.2 A non-refundable booking fee will be charged to the Client upfront at the time of confirming the booking.

  • 5.3 Once the babysitting session is complete, both the Client and the Babysitter Candidate must confirm the hours worked.

  • 5.4 Upon confirmation, the final booking will be closed, and the Client will be charged for the hours worked plus a service fee.

  • 5.5 Separate booking fees apply for multiple or split bookings on the same day.

  • 5.6 Candidates may not be dispatched if the upfront booking fee has not been paid at least 24 hours prior to the start of the booking.

  • 5.8 Rockmybaby® reserves the right to adjust fees and service charges at its discretion.

  • 5.9 A minimum 3-hour booking is required.

6.0 Cancellation Policy (Babysitter & Nanny Bookings)

  • 6.1 Babysitter Cancellations

  • 6.1.1 Cancellations made within 3 hours of the booking start will be charged a 3-hour minimum.

  • 6.1.2 Event care cancellations within 7 days will incur a 50% fee.

  • 6.1.3 Rockmybaby® is not liable for no-shows or cancellations by Babysitter Candidates.

6.2 Nanny Cancellations

  • 6.2.1 Early Client cancellation: 50% of agency fee payable, minimum $750 + GST.

  • 6.2.2 Early Candidate cancellation: Full refund or replacement offer.

  • 6.2.3 Temporary placement cancellations within 24 hours: 50% of Nanny wage payable.

  • 6.2.4 Services may be cancelled immediately if a Candidate is mistreated, or the environment is unsafe.

7.0 Babysitter Refunds & Guarantee

  • 7.1 No guarantee of availability.

  • 7.2  If the booked Babysitter Candidate is unavailable and a replacement cannot be found, the booking fee will be credited or refunded.

  • 7.3 This applies to no-shows or cancellations by Candidates.

  • 7.4 Contact us immediately if concerns arise regarding a Candidate.

8.0 Nanny Refunds & Guarantee

  • 8.1 Guarantee applies only to invoices paid within the due date.

  • 8.2 No refund on agency fees. One replacement nanny is offered if the original nanny leaves within 4 weeks. Up to 3 nanny profiles will be provided.

  • 8.3 Guarantee void if Candidate leaves due to Client conduct or conditions.

  • 8.4 A placement is deemed successful after 4 weeks.

  • 8.5 No refund will be given if a nanny's temporary placement is reduced after the start date.

9.0 Home-Based Education Programme

  • 9.1 Clients must submit enrolment and identity documents before placement. Otherwise, placement fees apply.

  • 9.2 Clients agree to home visits by a Rockmybaby® Visiting Teacher for support and documentation.

10.0 Liability

  • 10.1 Clients waive the right to bring legal action against Rockmybaby® regarding published information.

  • 10.2 Rockmybaby® is not liable for accidents or misconduct by Candidates.

  • 10.3 Candidate vetting is thorough, but the final employment responsibility lies with the Client.

  • 10.4 Clients must ensure their insurance includes coverage for domestic employees.

  • 10.5 Rockmybaby® is not responsible for third party website content or links.

  • 10.6 Clients outside New Zealand must ensure compliance with their local laws.

11.0 Confidentiality

  • 11.1 Credit card payments are securely processed and PCI DSS compliant. Rockmybaby® website uses Windcave - our credit card payments are secure certified and compliant to the Payment Card Industry Data Security Standards (PCI DSS), as a level 1 processor; this includes quarterly scans of its systems and annual onsite audits by a Qualified Security Assessor (QSA). DPS PCI compliance validation can be found in VISA's Global List of PCI DSS Validated Service Providers.

  • 11.2 All communication between the Agency and Client is confidential.

  • 11.3 Clients must provide accurate and complete personal details.

  • 11.4 Babysitter Candidates may inform a friend/family member of their location for safety.

12.0 Privacy

  • 12.1 See our Privacy Policy for more details.

13.0 Warranties & Indemnities

  • 13.1 Clients are not agents of Rockmybaby®.

  • 13.2 No guarantees are made on Candidate suitability or character.

  • 13.3 Employment contracts and compliance are solely the Client’s responsibility.

  • 13.4 Clients agree to indemnify Rockmybaby® against any claims resulting from Candidate engagement.

  • 13.5 Site access is not guaranteed to be uninterrupted.

14.0 Disputes

  • 14.1 We aim to resolve disputes through mediation. Contact Head Office at info@rockmybaby.co.nz or call 0800 762 569.

  • 14.2 All dispute-related communication must go through Rockmybaby®, not the Candidate.

15.0 Copyright & Trademarks

  • 15.1 All website content is the property of Rockmybaby® IP Ltd and is protected by copyright law.

16.0 Governing Law

  • 16.1 These Terms are governed by New Zealand law.

  • 16.2 Rockmybaby® IP and copyright are owned by Rockmybaby Group, PO BOX 8720, Havelock North, NZ 4157.

  • 16.3 Rockmybaby® reserves the right to update these Terms at any time.
