Terms and Conditions: Candidates
By registering online as a Candidate and agreeing to our Terms & Conditions (via the required tick box), or by accepting any booking or placement, you agree to the terms outlined below. These terms support Candidate safety and uphold the standards of Rockmybaby® Group.
1.0 Contract
1.1 These Terms & Conditions form a legally binding agreement between you ("Candidate") and Rockmybaby® Nanny & Babysitting Agency ("Agency").
1.2 Completion of registration on our website and/or acceptance of any booking constitutes acceptance of these Terms.
1.3 "Client" refers to the person/family/employer using Rockmybaby® services.
1.4 "Nanny"refers to a registered childcare professional engaged by a Client for long-term, ongoing, part-time, or temporary in-home care.
1.5 "Babysitter" refers to a registered childcare professional engaged by a Client for short-term or casual care.
1.6 Posting false, incomplete, or illegal information is prohibited and may result in legal action.
1.7 Use of our services is conditional on agreement with these Terms. If you do not agree, please refrain from using the website. Rockmybaby® is not the employer of any Candidate. Candidates operate as independent contractors and are responsible for their own tax, legal, and business compliance obligations. Use of the Rockmybaby® platform or acceptance of any booking does not create an employment relationship.
1.8 Candidate Support: Candidates must contact Rockmybaby® with any concerns, changes in availability, client feedback, or questions about bookings. You are expected to keep us updated at every stage of a placement process. Communication must always go through the Agency, not directly with the Client, especially in case of dispute or conflict.
1.9 By registering with Rockmybaby®, you consent to being contacted via phone, email, or SMS for service updates, booking details, and feedback collection.
2.0 General Candidate Obligations
2.1 Candidates must complete the full onboarding process: registration, interview, references, police vet, ID, and current Child First Aid Certificate (or proof of course enrolment).
2.2 Candidates must not enter into private arrangements or accept direct work offers from any Client they have been introduced to through Rockmybaby®. Doing so will result in immediate removal from Rockmybaby® services and may incur associated fees or penalties.
2.3Candidates are responsible for the sole care of children during their shift and may not leave them unattended.
2.4 Candidate conduct must reflect Rockmybaby® values, including respectful use of Client property, limited personal phone use, and professional engagement.
2.5 Taking, storing, or sharing any photographs, videos, recordings, or private information about Clients or children is strictly prohibited without written consent. This includes posting on social media or messaging apps. Breaches will result in removal from the platform and may lead to legal action.
2.6 Rockmybaby® reserves the right to review a Candidate's public social media activity during the recruitment or onboarding process to ensure alignment with our values and standards of professionalism. Any public content (including photos, opinions, or affiliations) that may be perceived as discriminatory, inappropriate, or misaligned with Rockmybaby® values may result in removal from our network.
2.7 Any disputes must be addressed with the Agency, not the Client.
2.8 Candidates are independent contractors and are responsible for managing their own tax obligations, ACC levies, and business compliance. You are encouraged to consult with Inland Revenue or a registered tax advisor to ensure proper reporting and registration. Visit www.ird.govt.nz for details.
2.9 Candidate Conduct Monitoring: Repeated lateness, cancellations, or client complaints may result in suspension or removal from Rockmybaby®'s candidate network. Candidates are expected to uphold reliability, responsiveness, and professionalism in all bookings.
2.10 Performance Monitoring - Rockmybaby® may review Candidate performance, reliability, punctuality, and client feedback at any time. Ongoing access to bookings may be suspended or removed if the Candidate fails to meet agency standards.
2.11 Nature of Engagement – Contractor Status
By registering with Rockmybaby® and accepting bookings via the platform, the Candidate acknowledges that they are engaged as an independent contractor, not an employee.
Rockmybaby® does not supervise, control, or direct how the Candidate performs their duties. The Candidate is solely responsible for managing their own:IRD registration
Income tax obligations
ACC levies (where applicable)
Business structure and compliance
3.0 Babysitter Candidate Obligations
3.2 Candidates must contact Clients within 24 hours of accepting a booking (or sooner for urgent bookings).
3.3 Babysitting rates are determined and set by Rockmybaby®. These rates are fixed and cannot be negotiated. A minimum charge of 3 hours applies for each booking. For details on current regional rates, visit our Babysitting Fees page.
3.4 Babysitters must arrive before the scheduled start time and give notice if cancellation is required.
3.5 Rockmybaby® may remove Candidates for misconduct, such as no-shows, failure to attend a booking, or breaches of professional conduct and care standards.
3.6 All completed booking hours must be logged in your Candidate Dashboard after the session ends. The Client will confirm these hours. Unconfirmed hours may delay payment. Do not seek payment directly from the Client unless authorised in advance.
3.7 If travel, parking, or additional expenses apply to a babysitting booking, these must be agreed with the Client in advance and disclosed to Rockmybaby® at the time of confirming hours.
4.0 Safety Guidelines
4.1 Candidate safety is a top priority. If you feel unsafe or uncomfortable at any time during a booking, please contact Rockmybaby® immediately so we can support you.
4.2 We strongly recommend that you save Rockmybaby®'s contact numbers (0800 762 569 / 021 582 322) and notify a trusted friend or family member of your booking details, including the location, expected return time, and who you are working for.
4.3 If you experience inappropriate behaviour, unsafe working conditions, or any breaches of professional boundaries, you must notify Rockmybaby® immediately.
4.4 Child Protection & Reporting Obligations - Candidates must be familiar with and comply with New Zealand child protection laws. If a Candidate suspects abuse, neglect, or exploitation, they must report it to the relevant authorities and notify Rockmybaby® immediately. Failure to act may result in removal from the platform.
5.0 Babysitter Booking Cancellation Terms
5.1 We understand that plans can change. If you need to cancel a babysitting booking, please let Rockmybaby® know at least 72 hours in advance so we have time to find a replacement.
5.2 If something urgent arises and you need to cancel within 24 hours of the booking, please call both Rockmybaby® and the Client directly as a courtesy.
5.3 Once you’ve accepted a booking, honoring that commitment is important. Reliability is a big part of what makes our team so valued by families.
6.0 Nanny Placement Terms
6.1 If you're being considered for a nanny role, please keep Rockmybaby® in the loop. Let us know about any planned interviews, communications with the Client, or if you've been offered the job.
6.2 If you find out that you've been referred to the same nanny position by another agency, please let Rockmybaby® know straight away. It helps us manage the process fairly and professionally.
6.2.1 Dual Representation Disclosure - Candidates must inform Rockmybaby® if they are also being represented by another agency for the same or similar roles. Lack of disclosure may affect future placements or access to bookings.
6.3 As a nanny placed through Rockmybaby®, you’re covered under our Public & Statutory Liability insurance. This does not include incidents related to driving or use of the Client’s vehicle, so please ensure you’re covered under the Client’s insurance if driving is required.
6.4 Trial Periods: If you are placed on a trial basis, this will be treated as a temporary nanny booking and Rockmybaby® must be informed. Trial placements do not exclude you from full placement obligations if ongoing work results.
7.0 Home-Based Programme Nanny Obligations
7.1 If you're working as a home-based nanny or educator with Rockmybaby®, there are a few important responsibilities to help ensure children receive safe, high-quality care. These also help us meet Ministry of Education requirements:
Register on our website and complete all required documentation
Hold a current Child First Aid Certificate before starting work
Follow the Rockmybaby® home-based learning programme and policies
Participate in regular health and safety checks, and attend training or professional development when you can
Send your timesheets to payroll each week, and give at least two weeks' notice if you decide to end your contract with Rockmybaby®
8.0 Liability
8.1 By working with Rockmybaby®, you authorize us to hold and use information as outlined.
8.2 Rockmybaby® is not your employer and holds no liability for incidents on the job.
8.3 Candidates access third-party content or links at their own risk.
8.4 Candidates are responsible for following local laws and legal requirements.
8.5 Rockmybaby® is not liable for any reputational damage caused by a Candidate’s conduct either on or off the platform.
8.6 Misuse of the Rockmybaby® brand, platform, or client contact information may result in immediate removal and legal action.
8.7 While Rockmybaby® makes reasonable efforts to maintain platform access, we do not guarantee uninterrupted availability due to maintenance or external technical issues.
8.9 Access to bookings or placement opportunities is conditional upon your continued compliance with these Terms, the quality of your conduct, and Rockmybaby®'s internal performance reviews. Access may be suspended or withdrawn at the Agency’s discretion.
9.0 Confidentiality
9.1 All communications with Rockmybaby® are confidential.
9.2 Personal details must be accurate and kept up to date.
9.3 Babysitters may inform a trusted contact of booking details for safety.
10.0 Privacy
10.1 See our Privacy Policy for more information.
11.0 Warranties & Indemnities
11.1 Candidates are not agents of Rockmybaby®.
11.2 You are responsible for your work arrangements and legal compliance.
11.3 Rockmybaby® is not responsible for the content or operation of third-party platforms.
11.4 You agree to indemnify Rockmybaby® from claims arising from your engagements.
11.5 We strive for uninterrupted service, but cannot guarantee constant website availability.
11.6 Client Feedback Use - Feedback or reviews provided by Clients may be used internally by Rockmybaby® for performance monitoring, quality control, dispute resolution, or training purposes. By registering, you consent to this use.
12.0 Disputes
12.1 Contact Rockmybaby® for dispute resolution via info@rockmybaby.co.nz or call 0800 762 569 / 021 582 322.
12.2 Candidates must not contact Clients directly to resolve disputes, complaints, or concerns. All communication must go through Rockmybaby® to ensure confidentiality, safety, and impartial resolution. Breaches of this policy may result in suspension.
13.0 Copyright & Trademarks
13.1 All content on the Rockmybaby® website is owned by Rockmybaby® IP Ltd and protected by law.
14.0 Governing Law
14.1 These Terms are governed by New Zealand law.
14.2 Rockmybaby® IP and copyright are owned by Rockmybaby Group, PO BOX 8720, Havelock North, NZ 4157.
14.3 Rockmybaby® reserves the right to amend these Terms at any time.
